Knoxville Homeowner Avoids Foreclosure

We recently had another success for a local homeowner who was facing foreclosure and avoiding it. They contacted us last year at this time and we had a meeting with them. We covered all the options with them at that time. They decided they want to try to stay in the home and wanted to try a loan modification. So we helped them gather all the information they needed to try to do a loan modification. We helped them put the information together they needed and told them how to contact their lender to get them the information. After several months they were able to get a modification to their loan and it was successful for them for a while. But because their employment didn't improve as they had hoped they once again fell behind on their mortgage payments. We sat down and reviewed their situation and decided to try a short sale this time in order to avoid foreclosure. We contacted their lender and informed them we had the home on the market and were going to try a short sale. In the meantime the lender informed us they where going to be sending out someone to do a BPO. Which this kind of surprised us because that is usually done once you have an offer on the home.  I met the agent at the home as I always do for BPO and shared with them how we arrived at market value on the home. Then I got a call from the lender telling us that the price we had the home on the market for was too low. By this time we had several people who had looked at the home and had some interest but not at our list price. The home was in need of a great deal of cosmetic work along with some structural work which I shared with the lender. We also provided with inspection reports we had obtained on the issues. But the bank wouldn't move off their price. So I asked the negotiator well if you are stuck on your price and my seller doesn't want a foreclosure on his record. I said how about a deed-in-lieu? They said they would go to their supervisors about that and try to make it happen. I got a phone call a few days later from the lender who said they would do a deed-in-lieu. I said great we got some updated title work and made it happen for my sellers. My seller was happy they avoided foreclosure and I guess the lender is happy they can try to get the price they think the house is worth in its current condition. Question From A Knoxville Homeowner…My Lender Just Sold My Mortgage..Is That Good Or Bad?

I recently had a meeting with a Knoxville homeowner who was having trouble making their mortgage payments. They contacted me to discuss their options in order to avoid foreclosure and asked me about his mortgage which had recently been sold from his original lender he asked “My loan was just sold. I was making payments to CitiFinancial and they sold it to Nationstar. Is that good or bad?” the homeowner asked. Here is the answer. It’s neither good nor bad. In fact, I don’t think your loan was sold. You see, most loans were packaged up and sold to Fannie Mae, Freddie Mac, or Wall Street. Their loan was more than likely packaged up and sold off. I asked him who his original lender was. He said it was a company called First Magnus. (First Magnus declared bankruptcy in 2007 and was afterwards closed.) Knoxville Home Saver has negotiated short sales on loans that were originally with First Magnus. The last one was sold to a large Wall Street Firm and securitized. That means this sellers loan could be owned by anyone. More than likely it is owned by Fannie Mae or Freddie Mac. If not, then it was probably sold to a Wall Street Firm. The owner of the loan hired CitiFinancial to act as their front man. That means Citi collected the payments, handled escrow and accounting, and manages debt collections and foreclosures. More than likely Nationstar did not buy the loan. Instead whoever owns the loan hired them to act as the front man instead of Citi. Wells Part Of The Robo Mess

Wells Fargo admitted last week that it made mistakes on the paperwork of literally thousands of foreclosure cases. The bank plans to refiled documents in November for some 55,000 cases. Interesting news, given the fact that Wells Fargo had previously denied it was part of the robo-signing scandal that has plagued the likes of JPMorgan Chase, GMAC, Bank of America and others. Now, however, with the massive re-filing of 55,000 cases, Wells Fargo can’t really play that tune any longer. Granted, Wells Fargo did not join the other banks when they put a temporary moratorium on closings in some or all of the states to buy time to check files. However, when you have a Wells Fargo spokesperson say something like the following, you begin to wonder whether perhaps they should have taken the time and joined the others: “We don’t believe that there are instances in which the foreclosures would not have occurred otherwise.” Well as long as you “don’t believe,” I guess that should be enough for millions of stressed out homeowners who are just trying to make ends meet each month or keep the foreclosure wolves at bay. Would all these high-up bank executives, who are many layers removed from all the muck going on at the street level of the foreclosure process, behave this way if they had sisters, mothers or grandmothers receiving foreclosure notices that may or may not be legitimate? Or perhaps Wells Fargo is just too busy spending tens of millions of dollars on branding over the Wachovia name. In late October, Wells Fargo officially changed outside signage on all the Wachovia banks. Couple that with all the collaterals they are in the process of changing and all the commercials and ads to announce how wonderful it will be now that the merger is complete. With that kind of money being used to keep feeding the marketing machine, who needs to worry about pesky details such as erroneous foreclosure paperwork, fact-checking, policing oneself or even training people in the foreclosure department to do their jobs properly? After all, it’s only affecting homeowners who probably can’t make too much noise and can’t afford to hire some high-priced attorney to fight the mega bank. It was a very nice home on 26 acres very private setting and the home was in great condition. My seller bought the home a few years ago for $470,000 with 100% financing.
